Wills, Trusts and Estates (20424). 3 units. An introductory course treating the various means of gratuitous transfer of wealth by will, trust, and intestacy. We will discuss the policy bases of inheritance and the changing patterns of intergenerational wealth transfer; probate administration and procedure; the creation of wills; and the creation and management of common law trusts. We will also cover basic features of federal transfer and inheritance taxation. The course will mainly cover state law, with special attention to the relevant portions of the Uniform Probate Code, the Uniform Trust Code, and the Restatements (Third) of Trusts and Property.
